Terms and Conditions of Sale (OBD2.com)

These Terms and Conditions of Sale apply to all purchases made on the website OBD2.com, published by MSE SHOP, SASU with a share capital of €1,000 — RCS Toulouse B 950 919 068 — SIRET 950 919 068 00029 — VAT ID FR20950919068. By confirming an order on OBD2.com, the customer acknowledges having read and accepted these Terms.


1. Principles

These Terms constitute the entire agreement between the parties and prevail over any other document. The seller may update the Terms at any time; the version online at the time of order applies. If a provision is missing, current practices in French distance selling shall apply.

2. Scope

These Terms define the rights and obligations of the parties for the online sale of goods offered on OBD2.com (notably: automotive diagnostic tools and related products). Deliveries are available to mainland France and Corsica; for DOM-TOM or international delivery, contact hello@obd2.com.

3. Pre-contract Information

Prior to ordering, the buyer receives clear information on: (i) essential characteristics of the goods; (ii) price and its calculation; (iii) any additional shipping or delivery charges; (iv) delivery dates/lead times; (v) seller identity and contact details; (vi) legal guarantees; (vii) digital content features and interoperability where applicable; and (viii) other contractual conditions as required by French Consumer Code L.221-5.

4. Orders

  1. Orders are placed online within the limit of available stock. The buyer is informed in case of unavailability.
  2. To validate an order, the buyer must accept these Terms, choose a delivery address/method, and select a payment method.
  3. The sale is final after: (a) email confirmation of acceptance by the seller, and (b) full receipt of payment.
  4. The seller may suspend an order in case of payment issue, incorrect address, or account problem until resolved.

5. E-signature

Providing card details online and final validation constitute buyer’s consent, enforceability of amounts due, and express acceptance of the transaction. In case of fraudulent card use, contact the seller immediately: +33 6 28 61 59 58.

6. Order Confirmation

The buyer receives an order confirmation by email.

7. Proof

Computerized records kept under reasonable security are proof of communications, orders, and payments. Order forms and invoices are archived on a reliable, durable medium.

8. Product Information

Products offered are those listed as sold and shipped by the seller, within stock limits. Descriptions and photos are provided as accurately as possible; photos are non-contractual.

9. Prices

Prices are in euros, VAT included, excluding delivery charges shown prior to checkout. The seller may modify prices at any time but applies the price in force at order validation. Changes in taxes or eco-fees may affect final price.

10. Payment Methods

Orders are with obligation to pay. Accepted methods (as displayed on site) may include: bank card, PayPal, check, bank transfer. The seller may suspend handling/shipping upon payment refusal or outstanding disputes.

11. Availability • Refunds • Cancellation

Unless force majeure or announced store closures, shipping times begin on the order registration date indicated in the email confirmation.

  • France/Corsica: Indicative dispatch within 2 business days for orders placed before 2 p.m. (La Poste priority). Maximum 30 business days after contract conclusion.
  • DOM-TOM / International: Terms communicated case by case.

If delivery deadline is not met, the buyer may enjoin the seller to deliver within a reasonable additional period. Failing that, the buyer may cancel the order by written notice. The seller then refunds all sums within 31 days of cancellation.

In case of unavailability, the buyer may cancel and obtain a refund within 31 days or request an exchange.

12. Delivery

Delivery occurs when the buyer gains physical possession or control. Goods are shipped to the address provided; reshipments due to incorrect/incomplete address are at buyer’s cost. If absent, a notice is left for pickup.

Upon delivery, if the original packaging is damaged/opened, the buyer must check items and refuse the parcel if damaged, noting “refused: opened/damaged” on the delivery slip. Any anomaly (damage, missing items, etc.) must be handwritten on the slip and signed, then confirmed to the carrier by registered letter within two business days, with a copy to the seller.

Returns require prior request within 31 days of delivery and acceptance only for items in original condition (packaging, accessories, manuals…).

13. Delivery Errors / Non-conformity

Any claim regarding delivery error or non-conformity must be made the day of delivery or the next business day: Tel +33 6 28 61 59 58 or Email hello@obd2.com. After validation, a return/exchange number is issued. Items must be returned complete in original packaging by tracked/insured parcel to the address communicated by support. Return costs are borne by the seller in case of seller error.

14. Legal Guarantees

14.1. Conformity (French Consumer Code L.217-3 et seq.)

  • Buyer has 2 years from delivery to act.
  • Buyer may choose repair or replacement (subject to cost conditions L.217-17).
  • Non-conformity is presumed within 24 months for new goods (12 months for used).

14.2. Hidden Defects (Civil Code 1641 et seq.)

The seller is liable for hidden defects making the item unfit for intended use. Buyer may seek rescission or price reduction (Civil Code 1644). Action within 2 years of discovering the defect.

15. Right of Withdrawal

The buyer has 31 days from delivery to return any item for exchange or refund without penalty (return shipping at buyer’s expense). If the buyer selected a paid delivery option at checkout, those fees are non-refundable.

Returns must be in original condition and complete (packaging, accessories, manuals) with invoice. Damaged/soiled/incomplete items are not accepted.

The right may be exercised online using the withdrawal form available on the site or via any unambiguous statement. Upon valid withdrawal, product price is refunded; return costs remain with the buyer. Exchange (subject to stock) or refund is processed within 72 hours and no later than 14 days from receipt of returned goods.

Exceptions (L221-28)

Withdrawal does not apply to, e.g., customized goods, unsealed items for hygiene reasons, goods likely to deteriorate rapidly, mixed goods inseparably, audio/video/software unsealed, newspapers/magazines (except subscriptions), digital content not supplied on a tangible medium once execution has begun with prior consent, etc.

16. Force Majeure

Events beyond the parties’ control preventing normal performance (e.g., transport blockages, natural disasters, telecom outages) suspend obligations. If lasting more than three months, the harmed party may terminate the contract.

17. Intellectual Property

Website content remains the seller’s intellectual property. Any total or partial reproduction is prohibited and may constitute infringement.

18. Data Protection

Personal data are necessary to process orders and invoices and may be shared with service providers (payment, logistics, support) strictly for these purposes. 19. Severability

If any provision is held invalid, the remaining provisions remain in force.

20. No Waiver

Failure to enforce any provision shall not be construed as a waiver of such provision.

21. Headings

Section headings are for convenience only and shall not affect interpretation.

22. Contract Language

These Terms are provided in English. In case of translation, the French version prevails in the event of a dispute.

23. Mediation & Dispute Resolution

In case of dispute, the parties will seek an amicable solution. Failing agreement, the consumer may refer the matter free of charge to the mediator AME CONSO within one year of a written complaint to the seller:

24. Governing Law

These Terms are governed by French law. The competent court is the tribunal judiciaire. The buyer should first contact the seller to seek an amicable resolution.

25. Personal Data — Details

Data Collected

  • Account: first/last name, email, phone, postal address.
  • Login: connection and usage data, location, payment-related data.
  • Profile: optional address and phone.
  • Payment: bank/credit card data processed by our PCI-DSS compliant providers (not stored by OBD2.com).
  • Communications: messages exchanged via the site (temporarily stored).
  • Cookies: see browser settings and our Cookie Policy.

Purposes

  • Provide and improve the website and payment services;
  • Verify and authenticate user data;
  • Allow users to communicate and receive support;
  • Personalize content and advertising according to preferences;
  • Prevent fraud/malware and manage security incidents;
  • Manage disputes; send commercial information per user preferences.

Sharing

  • With banks/payment providers to process payments;
  • With service providers (support, advertising, logistics) under confidentiality obligations;
  • When required by law or legal process;
  • In mergers/acquisitions/asset transfers (users informed beforehand).

Security

We implement organizational, technical, and physical measures to protect data; however, internet transmission/storage cannot be guaranteed fully secure.

To exercise rights of access, rectification, deletion, restriction, objection, or portability, email hello@obd2.com.

Changes

We may modify this clause; updated versions will be posted online and, when material, notified by email at least 15 days before taking effect.
